Welcome to Jobflow. These Terms of Service ("Terms") govern your access to and use of Jobflow's website, mobile application, and services (collectively, the "Service"). By using our Service, you agree to be bound by these Terms.
1. Acceptance of Terms
By creating an account or using the Service, you agree to these Terms and our Privacy Policy. If you are using the Service on behalf of a business, you represent that you have authority to bind that business to these Terms.
2. Description of Service
Jobflow provides an AI-powered operations platform for construction and trades businesses. The Service includes features for automated scheduling, customer communication, social media management, bidding, invoicing, and related business operations.
3. Accounts
3.1 Account Creation
To use the Service, you must create an account with accurate and complete information. You are responsible for maintaining the security of your account credentials.
3.2 Account Responsibilities
You are responsible for all activity that occurs under your account. You must notify us immediately of any unauthorized access or security breach.
4. Acceptable Use
You agree not to:
- Violate any applicable laws or regulations
- Infringe on the rights of others
- Send spam, unsolicited messages, or deceptive communications
- Interfere with or disrupt the Service
- Attempt to gain unauthorized access to any part of the Service
- Use the Service to compete with Jobflow
- Resell or redistribute the Service without authorization
- Upload malicious code or content
5. AI-Generated Content and Actions
5.1 Oversight
Jobflow uses AI to automate certain business operations on your behalf. You retain ultimate responsibility for all communications, commitments, and actions taken through the Service, including those generated by AI.
5.2 Review and Override
You can configure the Service to require approval for certain actions. You can review, edit, or override any AI-generated content or action. We recommend regularly reviewing AI activity, especially during initial setup.
5.3 No Guarantees
While we strive for accuracy, AI-generated content may contain errors. You should review important communications before they are sent and verify critical information.
6. Fees and Payment
6.1 Subscription Plans
Certain features require a paid subscription. Fees are described on our pricing page and may change with notice. Changes will not affect the current billing period.
6.2 Billing
Subscriptions are billed in advance on a monthly or annual basis. Payments are processed through Stripe. You authorize us to charge your payment method for all applicable fees.
6.3 Cancellation
You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial periods.
7. Intellectual Property
7.1 Our Property
The Service, including its design, features, and content created by Jobflow, is owned by us and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks or branding.
7.2 Your Content
You retain ownership of content you create or upload. By using the Service, you grant us a license to use, store, and process your content as necessary to provide the Service.
8. Third-Party Services
The Service integrates with third-party services (Google, Meta, etc.). Your use of these integrations is subject to the respective third-party terms. We are not responsible for third-party services.
9. Privacy
Our collection and use of personal information is described in our Privacy Policy, which is incorporated into these Terms.
10. Disclaimers
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE. WE DISCLAIM ALL WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, JOBFLOW SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.
OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.
12. Indemnification
You agree to indemnify and hold Jobflow harmless from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any rights of another.
13. Termination
We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason with notice. Upon termination, your right to use the Service ceases immediately. You may export your data before termination.
14. Changes to Terms
We may modify these Terms at any time. Material changes will be communicated via email or through the Service. Continued use of the Service after changes constitutes acceptance of the modified Terms.
15. Governing Law
These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in Travis County, Texas.
16. General
These Terms constitute the entire agreement between you and Jobflow regarding the Service. If any provision is found unenforceable, the remaining provisions will continue in effect. Our failure to enforce any right does not waive that right.
